Clear terms for a small, useful tool.

These terms govern the purchase, download and use of Photo JSON Rescue. Mandatory consumer rights under applicable law remain unaffected.

1. Seller and contact

The seller is AVSOF di Enrico Bisco, Via Villanova 91, 35020 Saonara (PD), Italy, VAT / P.IVA IT05793440289, tax code / C.F. BSCNRC78R02A059H. Contact: info@avsof.com or +39 049 6747089.

2. Product and system requirements

Photo JSON Rescue is downloadable Windows software that helps match Google Takeout media with JSON sidecars and restore available metadata. System requirements are 64-bit Windows 10 or Windows 11, enough free disk space for the new collection, and permission to read the source folders and write the destination. Photo processing is local and offline; internet access is required only for the initial download and optional updates or support. The buyer is responsible for confirming compatibility and keeping a separate backup before bulk changes.

The purchase includes initial configuration and installation assistance by email for the purchased release. On request, AVSOF helps the named buyer install the package, select the extracted Takeout folder and understand the first audit or sample test. This assistance does not replace the buyer's backup and does not guarantee recovery of metadata that is absent or damaged in the export.

3. Price, payment and delivery

The launch price is EUR 9.99 for the one-time software licence, including the initial configuration and installation assistance described above, unless a different total is clearly shown at checkout and in the order confirmation. Applicable tax information and the total price are presented before payment. Payment is processed through Stripe. Do not send card details to AVSOF by email.

The contract is formed when payment is accepted and an order confirmation is made available. Download access is supplied by a protected link in the order email after Stripe confirms payment through a verified server event. If a technical problem prevents delivery, contact AVSOF with the order email and transaction reference.

The current Windows release is distributed without an Authenticode code-signing certificate. Windows may display “Unknown publisher” before it runs. AVSOF publishes and verifies the exact package SHA-256 value, but that integrity check is not a digital publisher signature. This status is shown at checkout and on the protected download page.

Stripe may provide a paid-invoice or receipt PDF. Where an Italian electronic invoice is legally required, the fiscal document is transmitted through the applicable electronic-invoicing process using the billing and tax details supplied at checkout. The buyer is responsible for entering accurate fiscal details.

4. Download access and licence

The protected link is normally valid for 30 days and authorises one download session. After that session begins, a short retry window supports interrupted or ranged transfers. Email-security scanners cannot start the session automatically because a deliberate click is required. A verified buyer may contact support if a genuine technical failure requires the entitlement to be reset.

Subject to payment and these terms, AVSOF grants the buyer a limited, non-exclusive, non-transferable licence for one named user to install and use the purchased version on computers that user controls, for personal or internal business purposes. The buyer may make a reasonable backup copy.

The buyer may not resell, sublicense, rent, distribute or make the software available as a hosted service; remove ownership notices; or reverse engineer it except where such restriction is prohibited by mandatory law. A one-time purchase is not a promise of lifetime support or every future major version.

5. EU/EEA consumer withdrawal for digital content

An EU/EEA consumer generally has 14 days to withdraw from a distance contract. For immediate digital delivery, checkout asks for prior express consent for performance to begin during that period and acknowledgement that the withdrawal right is lost once download or access begins. AVSOF confirms that acknowledgement in the order email. If those legal conditions are not met, the statutory withdrawal right is not removed.

During the statutory withdrawal period you can use the continuously available online withdrawal function at https://photos.avsof.com/withdrawal. It lets you submit and confirm an unequivocal withdrawal statement and sends an acknowledgement by email without undue delay. You may still use email or another method permitted by law.

This does not limit remedies for defective or non-conforming digital content. To request support, withdrawal where available, or another statutory remedy, email info@avsof.com with the order details.

Model withdrawal notice: “To AVSOF di Enrico Bisco, Via Villanova 91, 35020 Saonara (PD), Italy, info@avsof.com: I hereby give notice that I withdraw from my contract for Photo JSON Rescue, ordered on [date]. Name: [name]. Address: [address]. Date: [date].” Different wording may be used if the decision to withdraw is clear.

6. Updates, support and open-source components

AVSOF may provide fixes or updates reasonably needed for security, compatibility or conformity. New major versions or additional services may be priced separately where allowed by law. When activated with the private key supplied after purchase, the software checks at most once every 30 days and offers an eligible update for approval; it does not silently replace the installed application. The update service may be disabled by removing the key, without affecting local photo processing. Support is offered at info@avsof.com.

The software may include or operate with third-party open-source components, including ExifTool. Those components remain governed by their respective licences and notices, supplied with the software where required. Third-party names do not imply endorsement.

7. Safe use and customer responsibilities

Keep an independent backup before processing valuable or irreplaceable media. Use audit and sample-test features before a large run and review reported exceptions. Do not interrupt disk writes, and ensure adequate storage, power and access permissions. Use the software only on files you are authorised to process.

8. Conformity, warranty and liability

AVSOF provides the digital content in conformity with mandatory consumer law. Because Takeout archives and file formats vary, AVSOF does not promise that every sidecar can be matched or every metadata field can be written. Nothing excludes or limits liability where exclusion is unlawful, including mandatory consumer remedies and liability for fraud, wilful misconduct, gross negligence, death or personal injury.

To the maximum extent permitted by law, AVSOF is not liable for indirect or consequential loss, lost profits or loss caused by failure to keep a reasonable backup. For non-consumer purchases, aggregate liability connected with the product is limited to the amount paid for it, except where prohibited.

9. Google disclaimer

Photo JSON Rescue is an independent AVSOF product and is not affiliated with, sponsored by or endorsed by Google LLC. Google and Google Takeout are trademarks of Google LLC. Compatibility references identify the export format the software is designed to handle.

10. Governing law and disputes

These terms are governed by Italian law, without depriving a consumer of mandatory protections available in the country of residence. Courts are determined by applicable law; an EU consumer may bring proceedings in the courts available under mandatory consumer-jurisdiction rules. Contact AVSOF first so the parties can try to resolve a problem.

11. Changes and severability

AVSOF may update these terms for future purchases when the product, checkout or law changes. The version accepted at purchase continues to govern that order unless a mandatory update applies. If one provision is unenforceable, the remaining provisions continue to apply.
